Visitor Visas

For people to visit or extend their stay in Australia for holiday, sightseeing, social or recreational reasons, to visit relatives, friends or for other short-term non-work purposes.

Skilled Visas

Temporary Graduate Visa – Subclass 485

This is a temporary visa that allows international students to live, study and work after you have finished your studies from 18 months to 4 years depending on your qualifications.

Skilled Independent Visa – Subclass 189
  • – Points tested stream

This is a permanent visa for skilled visa applicants whose occupations are on the specific list of occupations and who meet the minimum points test required.

  • – New Zealand stream

This is a permanent visa for eligible New Zealand citizens with a New Zealand Special Category (subclass 444), have lived in Australia for at least 5 years and meet the income threshold for each of the four completed income years at the time of lodging the visa application.

Skilled Nominated Visa – Subclass 190

This is a permanent visa for skilled visa applicants nominated by an Australian state or territory and who meets the minimum points test required.

Skilled Regional (Provisional) Visa – Subclass 489

This is a temporary visa that allows skilled workers to live and work in specified regional areas in Australia for up to four years who are either nominated by a State or Territory Government or are sponsored by an eligible relative living in a designated area in Australia. The visa holder can apply later on for permanent residency through the Skilled-Regional (Residence) visa.

Temporary Skill Shortage Visa (TSS Visa) Subclass 482

This is a temporary visa that allows an employer to sponsor a suitably overseas skilled worker to fill a position that cannot be filled in by a skilled Australian.

Employer Nomination Scheme – Subclass 186
  • – Direct Entry Stream

This is a permanent visa for skilled overseas workers, who are nominated by an Australian employer, and will allow them to live and work in Australia permanently.

Applicants for this stream must have:

  • an occupation in the Medium Long Term Skill Shortage List (MLTSSL)
  • nominated by Australian employer
  • a positive skill assessment
  • three years of employment at the required skill level
  • less than 45 years of age
  • – Transition Entry Stream

This is a permanent visa for current subclass 457 or 482 visa holders who have worked for at least 3 years before the nomination of their employer is made.

Applicants for this stream must have:

  • have work with their employer on a 457 or 482 on their nominated occupation for at least 3 years
  • nominated by Australian employer
  • the work is full-time
  • less than 45 years of age
Regional Sponsored Migration Scheme (RSMS) – Subclass 187

This is a permanent visa for skilled overseas workers, who are nominated by an Australian employer in regional Australia.

Applicants for this stream must have (basic eligibility):

  • be nominated by an approved Australian employer for a job in regional Australia
  • be under 45 years of age
  • meet the skills, qualifications and English language requirements

Family and Partner Visas

There are a number of migration options for fiancés, partners, children, parents and other family members of Australian citizens, Australian permanent residents or eligible New Zealand citizens.

Partner Category

Partners and fiancés of Australian citizens, Australian permanent residents or eligible New Zealand citizens may enter and/or to remain permanently in Australia. Partner category migration may apply to:

  • people intending to get married (fiancés)
  • married (de jure) partners
  • de facto partners (including those in a same-sex relationship).
Parent

Parents may be able to migrate to Australia if they have a child in Australia who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Child

For dependent children, orphan relatives or adopted children of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Other Family

Aged dependent relatives, remaining relatives and carers of Australian citizens, Australian permanent residents and eligible New Zealand citizens may apply for visas to come to Australia permanently.

Business Visas

Subclass 188A – Business Innovation and Investment (Provisional) Visa

This is temporary visa for 4 years for successful business owners or investors from overseas who are willing invest in new or existing business in Australia. Once you have established a business in Australia for 2 years, you can apply for permanent residence through the Business Innovation & Investment (Residence) Subclass 888 visa.

Subclass 188B – Investor Stream Visa

This is a temporary visa for 4 years for overseas owners or investors who want to make a designated investment of at least AUD1.5 million in an Australian state or territory and maintain business and investment activity in Australia. Once you have maintained an investment in Australia for 4 years, you can apply for permanent residence through the Business Innovation & Investment (Residence) Subclass 888 visa.

Subclass 188C – Significant Investor Stream Visa

This is a temporary visa for 4 years for overseas applicants who are willing to invest at least AUD5 million into complying significant investments in Australia and want to maintain business and investment activity in Australia for 4 years to obtain permanent residence.

Subclass 188D – Premium Investor Stream Visa

This is a temporary visa for overseas applicants who are willing to invest at least AUD15million into complying premium investments in Australia and want to maintain business and investment activity in Australia. Applicants must be nominated by Austrade on behalf of the Australian government. Once you have maintained a complying premium investment for at least 1 year and meet other requirements, you can apply for permanent residence through the Business Innovation & Investment (Residence) Subclass 888 visa.

Subclass 888 – Business Innovation and Investment (Permanent) Visa

This visa is the second stage of the Business Innovation and Investment Visa. You can apply for this 888 permanent visa after holding the 188 Provisional Visa either for 2 years in the Business Innovation Stream or 4 years in the Investor Stream and you have met all prescribed criteria.

Subclass 132C – Business Talent Visa

This is a permanent visa for high calibre business people who are owners or part owners of overseas business and have a genuine and realistic commitment to participate in the management of a new or existing business in Australia.

AAT Appeal

In case of visa refusal or cancellation, an application for review to the Administrative Appeal Tribunal (AAT) is an available right and option. AAT has the power to:

      • affirm the primary decision
      • vary the primary decision
      • set aside the primary decision and substitute a new decision
      • remit (return) a matter to the Department for reconsideration with specific directions.

Australian Citizenship

Australian citizenship can be obtained in number of ways:

      • By conferral – for permanent residents of eligible New Zealand Citizens
      • By descent – for people born overseas to a parent who is or was an Australian citizen and for parents to register a child born overseas

An applicant must also satisfy the following criteria to be eligible for citizenship:

      • is a permanent resident or eligible New Zealand citizen at the time of application and decision
      • satisfy the residency requirements in Australia
      • is of good character
      • intend to live in Australia or maintain a lasting link with Australia while overseas.
